The Arc of Massachusetts 2021-22 Transition Conference

Due to the pandemic, the Arc is offering this year’s Transition Conference in a hybrid model. The conference will be based on the Frameworks from Charting the LifeCourse. Families of loved ones 13-26 are encouraged to attend.

Fletcher Tilton attorney Frederick Misilo, Jr. will be doing a workshop on November 10th, 12:00-1:30 p.m.

Title: Legacy Planning – A new way of thinking about special needs planning.

Workshop Description: Most estate planning and special needs workshops focus almost exclusively on wills, supplemental needs trusts, and other legal documents prepared by attorneys. While such basic knowledge is important, planning for the future of a family member with an intellectual and developmental disability doesn’t begin or end with the creation of legal documents. It is not best viewed by solely thinking about the transfer of property upon the passing of a parent. It is useful to recognize that in the very early days of what would now be termed “estate planning”, people would also include a section on the transfer of “life lessons”, “wisdom” and/or “values” that were deemed to be important for the next generation to carry with them. Such an approach reflected a respect for the depth of one’s life experience and for the value of passing those experiences on for the next generation to build on. This is part of what I call “Legacy Planning” – It is the process of transferring not only property but wisdom, values, and vital knowledge to the next generation that will enrich all who are part of this process. This workshop will offer an alternative approach to special needs planning in a way that stretches far beyond a traditional, legalistic viewpoint. The workshop will quickly cover and then extend beyond the basics of special needs trusts. We’ll encourage participants to stretch their thinking on how to approach planning and seek to provide examples of pursuing a holistic approach that contemplates a life-long journey of developing and creating a legacy which continues to develop and build into the next generation of family members and supporters.
